
Our client was a serious triathlete on a training bicycle ride. She had the right of way but an inattentive motorist, who was talking on a cell phone, failed to yield the right of way. The motorist turned left into her path, knocking the cyclist off her bike. As a result, our client suffered a fractured hip and was taken by ambulance to the hospital for care. This driver was from Kansas, visiting temporarily in Georgia. The insurance company wouldn’t settle the case, but we filed a lawsuit and the policy limits were tendered. We then proceeded to go after our client’s insurer for her policy limits which were finally paid. The client did not have surgery on her hip. Instead, she had extensive rehabilitation so that she could begin training for triathlon competitions once again.
