What is a Medicare Set-Aside account

A Medicare Set-Aside (MSA) account is a financial arrangement used to allocate a portion of a settlement, typically from a workers’ compensation or personal injury claim, to cover future medical expenses that would otherwise be paid by Medicare. The purpose of an MSA is to ensure that Medicare does not pay for medical expenses that should be covered by the settlement funds, thereby protecting Medicare’s interests.

Key Features of Medicare Set-Aside Accounts

  • Allocation of Funds: The funds in an MSA are specifically set aside to pay for future medical expenses related to the injury or illness covered by the settlement. These expenses must be ones that Medicare would typically cover
  • Exhaustion of Funds: Before Medicare will cover any related medical expenses, the funds in the MSA must be fully exhausted. Once the MSA funds are depleted, Medicare will resume paying for covered services
  • Voluntary but Recommended: Setting up an MSA is generally voluntary, but it is highly recommended to protect Medicare benefits and ensure compliance with the Medicare Secondary Payer Act. In certain cases, the Centers for Medicare & Medicaid Services (CMS) may review and approve the MSA to confirm that the amount set aside is appropriate
  • Administration: MSAs can be self-administered by the claimant or managed by a professional administrator. Proper management involves maintaining accurate records of all expenses paid from the MSA and ensuring that funds are used only for Medicare-covered services
  • Interest-Bearing Account: The MSA funds are typically held in a separate, interest-bearing account. The interest earned must also be used for medical expenses related to the injury

When is a Medicare Set-Aside Necessary?

An MSA is considered necessary under the following conditions:

  • The claimant is a Medicare beneficiary and the total settlement amount exceeds $25,000.
  • The claimant is expected to become a Medicare beneficiary within 30 months of the settlement, and the anticipated settlement amount exceeds $250,000

Failing to establish an MSA when required can have significant consequences, including the potential loss of Medicare eligibility and liability for medical expenses that should have been covered by the settlement. Overall, a Medicare Set-Aside account is a crucial tool for managing settlement funds related to future medical expenses, ensuring compliance with Medicare regulations, and preserving eligibility for Medicare benefits.

Medicare Assistance and Resources Available for Georgia Residents

Georgia residents can access additional Medicare-related assistance through programs like Georgia SHIP (State Health Insurance Assistance Program), which provides free, unbiased information and assistance to Medicare beneficiaries. This service can help individuals understand their Medicare benefits and make informed decisions about health care options, including those related to MSAs. For those in Georgia who may need financial assistance with Medicare costs, programs such as the Medicare Savings Programs and Extra Help (Low-Income Subsidy) are available.
